1. Was Rob’s choice justified? Why or why not?
I don’t consider Robs choice justified because he based his decisions on Cathy being a smoker. His personal views on smoking should not be dictate who is the best candidate. I understand that he dislikes smoking, sees it as disgusting, sign of weakness of character and the impact it could have on health insurance but other health factors could cause the same thing. Both Cathy and Jen had the same amount of experience, references and interviewed well.
2. Is it fair for an employer to refuse to hire a smoker? What about an overweight person? (Are there any relevant differences between a smoker and an over- weight person?) Be sure to define what you mean by ‘fair.’
I don’t think its fair for an employer to discriminate someone for a position because they smoke or are overweight as long as it does not affect their ability to perform or affect others. Unfortunately, its is the business owner or manager who determines the image they want to sell for their business and what is best in the interest of the business or the services they provide. Depending on their line of work the position may require the person to be fit and someone who is overweight or smokes may not be able to perform certain tasks.

Floor manager position requires to lead by example in appearance, behavior and work ethics so smoking is irrelevant to their responsibilities. Being a smoker will not affect their capacity or their experience but their work behavior will determine if they are a good fit. As long as they do not abuse breaks or allow it to interfere with their duties it should not be held against them. The Americans with Disabilities Act (ADA) “prohibits discriminating against an individual in the selection process” (Moran, 2014, p. 32) due to a potential disability. A disability can be defined as a mental or physical condition that can result in some sort of handicap. As a result, the employer may be required to accommodate the people who are considered as disabled, to help them perform his or her job duties.
Cosgrove who was the Cleveland Clinic’s chief executive. This particular clinic had recently stopped allowing smokers to work at their business. Leonhardt writes, “Cosgrove says that if it were up to him, if there weren’t legal issues, he would not only stop hiring smokers. He would also stop hiring obese people…people’s weight is a reflection of how much they eat and how active they are” (636-37). I thoroughly disagree with Cosgrove’s statements and here’s why.
The Company’s pledge to provide a safe and healthy work environment bans smoking on Company properties, including but not limited to break areas, bathrooms, and work areas. Employees who smoke will be able to do so only on break and lunch times. They will have to go outside of the Company’s facility in the designated smoking areas on the property.

Action on Smoking and Health (ASH, 2007; Richardson (2001) argued that manual groups are likely to smoke heavier than the managerial groups and stated likely reason for this such as food insecurity, substitute for food, social environment, segregation and pressure, lack of good health and lack of confidence. In addition to this, epidemiology statistics reported by Health and Social Care Information Centre (HSCIC, 2013 and Wanless, 2004) stated that smoking is more prevalent among the lower socio-economic groups and known to be key part of the disparities in life expectation between manual and non-manual groups. Therefore it is important something is done to eradicate inequality in the health of the general population.
Opinion: Kyle using his gender and former working relationship with a member accountable for making the selection is a prime example of poor ethics, and a dearth of morals. I will discuss the other problems Kyle generated as well as the course concepts involved in part 2.
For job advertisements, the EEOC has said it is illegal to publish an advertisement for a job that shows a preference for or discourages someone from applying for a job because of race, religion, excreta. There are people that abuse their “smoking privileges”. I personally hate smoking but as long as they don’t abuse their privileges on “smoking breaks” I would be okay with it. I can’t discriminate against anyone, because I know there are habits of my own that some people I’m sure hate as well.

Nicotine is highly addictive, which is one of the reasons why it is so dangerous. The nicotine withdrawals a person might go through can be one of the biggest reasons they cannot/will not quit. Smokers may know the dangers it causes, but have too much difficulty quitting and it is no longer an option for them.
