For many years, drugs have been the center of crime and the criminal justice system in the United States. Due to this widespread epidemic, President Richard Nixon declared the “War on Drugs” in 1971 with a campaign that promoted the prohibition of illicit substances and implemented policies to discourage the overall production, distribution, and consumption. The War on Drugs and the U.S. drug policy has experienced the most significant and complex challenges between criminal law and the values of today’s society. With implemented drug polices becoming much harsher over the years in order to reduce the overall misuse and abuse of drugs and a expanded federal budget, it has sparked a nation wide debate whether or not they have created more harm than good. When looking at the negative consequences of these policies not only has billions of dollars gone to waste, but the United States has also seen public health issues, mass incarceration, and violent drug related crime within the black market in which feeds our global demands and economy. With this failed approach for drug prohibition, there continues to be an increase in the overall production of illicit substances, high rate of violence, and an unfavorable impact to our nation.

Dangerous illegal drugs have plagued American citizens and their youth for as long as the country has been in existence. These harmful drugs are not only responsible for countless amounts of deaths, but the corruption of the American society in general. All too many times have these drugs been blamed for insanity, racism, rebellion, and straight up violence. Today the government is spending approximately $19.179 billion in one year to combat these evils (Gifford). Unfortunately, even with all of this effort going in to stop illegal drug use, the “War on Drugs” is yet to produce almost any positive results. In 2015, 1,488,707 people in the United States were arrested on drug charges. Nearly 84 percent of those arrest were for possession only. As one can imagine these arrest impact the American justice system greatly. Within America's prisons in 2010 more than half of all inmates were serving time based on drug related charges. The prisons within America are greatly overcrowded, and I believe that decriminalizing drug use could offer assistance in this situation.

Drugs have played a part of the United States of America criminal justice fabric for generations. The scare tactics of the 1960s gave way to the contradictory messages of the late ’70s and early ’80s. In the 1970’s drugs became glamorous and recreational to many citizens. Prior to the 1970’s, citizens that abuse drugs was seen by policymakers as suffering from a social disease that could only be helped by treatment. Policymakers posture change drastically in the mid 70’s. In 1973, only twelve percent of the population reported to the Gallup poll that they had tried drugs. By 1977, that number was doubled. Notably, in 1978, 66 percent of Americans said Marijuana was becoming a serious issue in their respective communities (Riley, K.

For many people, the thought of making drugs easily accessible for consumption by the masses may be frightening. After all, we have drug laws in place because they have the potential to be harmful. It also may not be difficult to imagine that it could very well be subject to failure due to a numerous amount negative externalities that may occur. Our nation has been engaged in a war on drugs for several decades now. The effectiveness of this war, however, is a topic that has continuously been debated. Some argue that universal legalization of drugs, an alternative that has never been tried, may have a greater benefits when compared to the present state of the war on drugs. On the other hand, the opposition believes that legalization would only pave the way for a vast amount of crime and many wasted resources.

As a nation we face a serious enemy that is not on foreign soil but here at home. The drug problem in this country has truly affected many lives and families. This enemy has no limits and affects our domestic tranquility. All drugs should not be legalized because they have the ability to impair judgment and do much bodily harm. Drugs have been a dark shadow lingering over our country for many years. In recent years, the heroine epidemic has spread throughout the nation; it has taken many lives and hurt many families along the way.

We should decriminalize drugs in the U.S. instead of legalizing them. Decriminalization refers to the lessening of criminal penalties of certain acts. According to De Marneffe, “… the legalization of drugs … [is] the removal of criminal penalties for the manufacture, sale, and possession of large quantities of recretational drugs, such as marijuana, cocaine, heroin, and methamphetamine” (346).

America’s war on drugs has failed. After millions of dollars and untold man hours spent enforcing the prohibition of illegal drugs, there is little, if any, success to show for it. Illicit drugs are still available on most American street corners, drug usage rates have not decreased, and the scourge of drug related violence continues to spread like wildfire. Sadly, the war on drugs has also resulted in the incarceration of millions of Americans for petty possession offenses and has created a black market for illicit drugs upon which criminal organizations, such as the Mexican cartels and even the Taliban, thrive. Decriminalization of drugs is the only way America will ever be able to eradicate its drug problem. Imagine a country where drug users were treated instead of imprisoned, where drug usage rates perennially fell, and where diseases such as AIDS and Hepatitis C were in decline. This isn’t a fantasy, drug decriminalization policies have been proven to work and they’re America’s only answer to the drug epidemic.

With addiction rates rising every year, the overwhelming drug dilemma has opened the eyes of numerous governments around the world. This paper will discuss what decriminalization is and if decriminalizing drugs in the United States will lead to lower crime rates and lower incarceration rates. In addition, it will discuss the impact decriminalization will have on society, the effect it will have on the economy and finally how it influences the now addicted, should legalization occur. Currently, Portugal has decriminalized all drugs in every drug classification for recreational use. Furthermore, Colorado is the only state in the United States, to have decriminalized marijuana. In looking at the drug laws in Portugal, Colorado, Mexico, and the Netherlands this review will examine what appears to be working and not working of both decriminalizing and keeping certain drug classifications illegal. Multiple web-based articles, books, and peer-reviewed articles were the many sources used in researching this paper. Can drug decriminalization be a practical way to cut down on drug related crimes? Today’s world is changing at a rapid pace. Things never thought to be possible are becoming very real. One of the popular subjects of wanting change is the legalization of drugs. There has already been a small amount of change in the drug legalization process with marijuana now being legal in a few of the states. Vanessa Baird in her work “Legalize Drugs- all of them!” argues for the legalization and decriminalization of drugs. John P. Walters counters Baird’s argument for legalization in his piece “Don’t Legalize Drugs.” Both authors take an extended look into the harsh reality of the drug war and the small progress it has made since it began.

If the United States were to decriminalize drugs, it would help keep people in America out of jail. More than 1.6 million people are arrested for drug abuse or drug possession every year. Because there are so many people in the jails, there is overcrowding and poor health care. That the taxpayer’s money is paying for. Drug legalization is an enduring question that presently faces our scholars. This issue embraces two positions: drugs should not be legalized and drugs should be legalized. These two positions contain an array of angles that supports each issue. This brief of the issues enables one to consider the strengths and weakness of each argument, become aware of the grounds of disagreement and agreement and ultimately form an opinion based upon the positions stated within the articles. The blatant disregard for drug addicts today is at an ultimate high. In the past two years alone, more people have died from opiate addiction than they have in the entire Vietnam War. The fact that drug users are seen as lower class members of society as only aided in the increase of addiction and death, killing more Americans than HIV/AIDS did at its peak. Though the epidemic did not occur overnight, it has recently become one of America’s biggest health confrontations. Although there is no absolute solution, in order to decelerate the prevailing wave of usage and overdose/death, decriminalization in correlation to government funded programs could give ease to the definition of the word “epidemic”.

Laws that prohibit the possession and use of street drugs are important as their aim is to protect the user, those around them, and society in general from undue harm. There has been a great push during the last 10 years to legalize marijuana and decriminalize other drugs such as cocaine and heroin on the basis that the recreational user, and even the hard-core addict, may not be causing significant harm to anyone, beyond their own personal health. In this sense, drug use is viewed as a personal choice and drug laws trample on personal freedoms without sufficient reason. Additionally, minorities are found to be arrested and convicted of drug crimes at disproportionate rates when compared to the demographics of those who use illegal drugs, which some see these type of laws as a tool of legal oppression, instead of a valid punitive function. Still, there remains sufficient reasons to maintain laws against the possession and use of controlled substances, such as marijuana, cocaine, and heroin; though there is a compelling argument for the lessening of the amount punishment of the majority of users that are caught with small amounts of street drugs. This paper seeks to put forward valid reasons for the continued prohibition of drugs, while also making a case for the softening of incarceration policies.
