Racial Profiling of the Black Male

Fruitvale Station depicts the real-life case of Oscar Grant III, a young unarmed black man shot in the back by a white police officer on January 1, 2009 in Oakland. The movie begins with cell phone footage of Oscar Grant’s death recorded by bystanders. Grant’s life was tragically cut short due to a white man’s racism and stereotypical perception of a young black man. The BART police officer Johannes Mehserle abused his authority and shot Grant for no other reason but hatred and racism. At the time of the shooting, Grant was unarmed and pinned on the ground in handcuffs. The movie then walks you through the last twenty-four hours of Grant’s life. As you watch the movie and research the aftermath of Grant’s death you a forced to ask yourself a few questions; why does the media have the right to take away Oscar Grant’s humanity? Where do we draw the line between racism and holding others responsible and will the public’s perception of black men and women ever change? Lastly, we must focus on how this case and others impacts African American society and culture. We also must focus on the necessary changes African Americans must make in order to survive in a world that does not value black lives.

There have been many attempts to make racial profiling illegal, but all have failed. Racial profiling is defined as suspecting an individual of a wrongdoing based solely on the individual’s race, ethnicity, religion, or national origin (Racial Profliling: Definition 2). Racism spreads throughout all dimensions of life in American society; therefore, the history of racial profiling is extensive, but it was at an all-time high after the September 11th attacks (Persistence of racial and ethnic profiling in the United States: a follow-up report to the U.N. Committee on the Elimination of Racial Discrimination 10). It can be used in both positive and negative aspects, but is mostly used negatively. Racial profiling negatively effects society and the very existence of racial profiling is erroneous, discriminatory, and unjustifiable.

Just what is racial profiling? Racial profiling is a law enforcement and security agency practice that encourages officers to stop, search, and investigate people based on race, ethnicity, nationality or religion. While racial profiling is most commonly committed against ethnic minorities, many instances of racial profiling occur in reaction to specific crimes, making any racial or cultural group subject to more intensive scrutiny by the authorities. (ebscohost.com) This is what I think bout racial profiling, it like it occurs when the police targets someone for investigation on the basis of that person's race, national origin, or ethnicity. What makes America? Is it the freedoms granted to any American citizen? Is it the way the founding fathers fought for their own freedom against Britain? Is it instead the racial history behind this nation? America, since its origins has been a country of immigrants and for immigrants, yet since its origins, there has been discriminatory laws against blacks, Latinos, Asians, and every other race that is not considered white or Caucasian. Has this country that has been based upon racial profiling, that has fought wars as one nation (and even against themselves at one point), and has triumphed through the Civil Rights movement finally succumbed to justice or is racial profiling just as prominent today? Racial profiling has been and will continue to be a problem in the United States. Many believe that racial profiling is more prevalent in today’s society; however, this issue has been a part of our society since slavery. Moreover, African American males are mostly the targets of racial profiling, especially in larger cities like New York City and Los Angeles. Racial profiling in the dictionary is “the assumption of criminality among ethnic groups: the alleged policy of some police to attribute criminal intentions to members of some ethnic groups and to stop and question them in disproportionate numbers without probable cause (“Racial Profiling”).” In other words racial profiling is making assumptions that certain individuals are more likely to be involved in misconduct or criminal activity based on that individual’s race or ethnicity. Racial Profiling is an act of automatically defining or identifying someone based on their ethnicity. This act was most recognized during the late 1800’s in the U.S. under the Jim Crow law. It was passed in order to segregate whites and the colored in America. It fundamentally made whites superior to all. Though, in 1964 the Civil Rights Act passed stating that anybody of any ethnicity or religion are to be equal and united. However, today this law has never been truly accepted when seeing the statistics of the type of people being stopped by the police. Racial profiling is simply, “the unlawful police practice of using race, color, or ethnic background, as the reason for conducting a traffic stop on an individual.” (Michigan Civil Rights Commission) This definition can be extended to any kind of discrimination mainly based on myths and stereotypes towards a certain race or ethnicity. However, the term racial profiling is commonly used when a police officer or any other law enforcer stops, questions, searches or arrests an individual purely on the basis of their race. African Americans or simply blacks have been the major racial group that has suffered much of racial profiling. Much of this is based on the stereotypes against the blacks are perceived as more likely to engage in criminal activities. For instance, in a 2013 Racial Profiling Data from Ferguson Police Department, out of 5384 police stops, 4632 were against blacks. (Ferguson Police Dept. 1) Despite the low population of blacks in U.S. compared to other races, the former continues being subjected to more racial profiling. Racial profiling against African Americans continues to expose the blacks to humiliation and racial injustices, as this paper will expose, thereby calling for the responsible authorities to address and find solutions for the problem.

So before I can answer this million dollar question I need to establish what racial profiling is. According to the American Civil Liberties Union it is “when law enforcement and private security target people color for humiliating and often frightening detentions, interrogations, and searches without evidence of criminal activity and based on perceived race, ethnicity, national origin, or religion.” In plain English this means a person is perceived to have committed a crime only because of their race.

Over the last twenty years the issue of racial profiling has become extremely combative with regards to law enforcement practices. A common misconception begins as some people are unaware of what racial profiling actually is. Racial profiling typically deals with incarceration, miss education, and to certain extent slavery. The topic of slavery is relevant in the conversation of racial profiling because like slavery, African Americans have suffered just due their own identity. Profiling is essentially the selection of an individual and categorizing them due to a specific racial group. Racial profiling is using someone’s race or ethnicity as a form of suspicion to have committed some type of crime. The negative stereotype of African Americans is a factor on why racial profiling exists. It is unlawful for an officer to stop an individual on the streets because of their race. Law enforcement often uses race as a proxy, it is perfectly legal to do, but it cannot be the only factor. This history shows patterns of racial segregation that are still persistent today. They may not be as straight forward, but the effects of the past decisions by police enforcing discriminatory laws are still evident. Racial profiling is when someone’s race is used by law enforcement to assume criminal suspicions (Spagnoli, Filip). Law enforcement has used racial profiling to “help” prevent criminal activity. For instance, a survey done by the department of justice when officers focused more on African-American and Latino drivers they found that less of them had drugs the when they least focused on white drivers (The Truth About Racial Profiling: FIVE FACTS). Some officers assume that Hispanics and African-Americans are carrying around illegal substances and weapons. This is not always true! As the survey revealed, most of the people who did have prohibited items were white Americans. Law enforcement should begin stopping drivers by suspicion not by their race. In another survey done by Ian Ayres and Jonathan Borowsky they had found very similar information. “We also found that, once people were stopped, officers were more likely to frisk, search, or arrest African-Americans and Latinos than whites…when these frisks and searches are substantially less likely to uncover weapons, drugs, or other types of contraband” (Borowsky, Ayres). Officers are spending more time on race than focusing on real criminals who are ousting the reasons why this country is remarkable.
