7. STATEMENT OF LAW
The examining agent’s report raises the following legal issue:
A. Proper Deduction of Work-Related Travel Expenses in 2009.
(1) Procedural Background.
Ican took $15,000 deduction for work-related expenses in arriving at his adjusted gross income in 2009.
(2) Deduction of Work-Related Expenses in 2009.
All ordinary and necessary expenses paid or incurred in carrying on any trade or business are deductible. To be considered engaged in a trade or business there has to be continuity and regularity. In addition profit must be the primary or dominant purpose for engaging in the activity.
Ican is in the business of writing books and deducted traveling expenses incurred while researching, writing, and arranging material for a book in accordance with section 162. He has devoted the last two years to his writing and has published one book. His writing is his only source of income. Although making a profit is not the only way to show that you are in the business of writing. He in fact has made a profit by publishing one book and has been given an advance on his current book. All this further solidifies that Ican is engaged in writing for a profit. In addition, unlike in Royster v Commissioner all of the expenses incurred by Ican have been properly

I have been assigned to reply to your questions and I have listed my recommendations below. I hope all of you are doing wonderful. The reason of this letter is because of my concern about the new federal discriminatory redlining policies affecting minorities. The Return Preparer Office has been intentionally discriminating against people without Social Security numbers unlawfully. Since there is no law against providing a ptin number to people without a SSN, and The Internal revenue service/Return Preparer Office position is unlawful. Therefore, I am appealing the IRS denial letter 4739 dated 3/24/2016.

Comm., 61 T.C. 554 (1974), the judgment of Congress was not to include independent contractors which possessed no financial stake in the corporation as retaining an interest in the corporation for attribution waiver rules. The Ninth Circuit Court of Appeals rejected this test by the Tax Court in Lynch v. Comm., 86-2 USTC ¶9731. The Court held that taxpayers providing post redemption services either as an independent contractor or employee, held an interest prohibited by §302 (c)(2)(A)(i). Mr. Cranston would fall under the jurisdiction of the Ninth Circuit Court because he is a resident of California, and the higher court prevails. Since the Ninth Circuit Court is a higher court than the Tax Court, the Lynch v. Comm case law prevails over the case law of the Estate of Lennard v. Comm.

If there is no service then there would be no business. When running a business, the costumer is always placed first. Poor services can results in a complaint from a guest. But that complaint can be used to better the business in the future.
