The Articles of Confederation Following the Revolutionary War, the new American Government was set up under the Articles of Confederation. The Articles of Confederation did not give the federal government enough authority to be effective. So in 1787 delegates from all the states attended a meeting known as the Constitutional Convention. Among those attending were James Madison, representing Virginia, William Paterson, representing New Jersey, and Roger Sherman, representing Connecticut.

With the United States new found independence from Great Britain, its founding fathers realize from their historical experiences that a document of law needed to be crafted and established to preserve its new found independence, while maintaining order. However, the first document crafted by the founding fathers, the Articles of Confederation, did preserve the country new found independence but it did not maintain order. While the Articles of Confederation unified the American colonies for the first time, the individual states had a hard time allowing a central government to solely control their territory. Due to fear of an all powerful monarchy like the one they had experienced in England the colonies were wary of allowing a central government certain powers. These certain powers included control of commerce, ability to tax, and even the ability to act directly upon individual citizens of a state. The Founding fathers did not want to create a government with too much power so they created the Articles of Confederation. This government turned out to be a failure. In 1787, the founding fathers met again to create a new framework of government. Most people feared creating a government that was too strong. To create a new government there had to be many compromises, the U.S. Constitution is the result of these compromises reached in Philadelphia in 1787. The Articles of Confederation were developed after the Revolutionary War, and were a good idea to help set standards for America. However, they had some major problems that needed to be solved in order for America to become a strong nation. After these problems were addressed the Constitution was developed.

One of the main disadvantages of the Articles of Confederation was that it encouraged a weak central government. Because nine out of thirteen states had to agree upon a law in order for it to be established, very few laws were passed. Amendments of the Articles of Confederation were never passed because the vote had to be unanimous. Not many decisions were made and the Congress generally only had the power to make treaties, deal with foreign affairs, and declare war. The Articles of Confederation read, “Each state shall contain its sovereignty, freedom and independence, and every power, jurisdiction, and right…” (Article II) The states had the most power and the Congress very rarely made decisions that affected the internal affairs of the states or country. There was only one house of Congress where each state only had one vote. This did not allow the bigger states with a greater population to have an advantage over the smaller states, which one could perceive as unfair in certain circumstances. Also, there was no judicial branch, which meant that if a case was not solved on a state level, it had nowhere to go. Fundamentally, the states held the most power. The lack of power within the Congress led to economic crisis.

This document was written in the 18th century specifically during the Federalist Era. It was written 18 years after America won independence from England on July 4, 1776. This lead to the creation of the “Articles of Confederation” which were made primarily for the people because they feared central government having all power. Then at The Annapolis Convention (1786) is where the groundworks of “The U.S. Constitution” were discussed to replace the “Articles of Confederation”.

The feebleness of Congress was a major weakness of the Articles of Confederation. When the Articles of Confederation were adopted in 1777, they created a “loose confederation” of states (Pageant, 181). This meant that each state was independent and sovereign, linked by Congress only to deal with common problems and foreign affairs. Congress was meant to be part of a united central power of the government, but due to the abuse suffered from the king, the states so limited the powers of the central government to the point of powerlessness.

The Article of Confederation was ratified in 1781. This Article was part of the formation of a national government in the United States. But, by 1787, a reform convention was held to address the Article’s weaknesses. This event also brought about tension in the country between two groups, the Federalists and Antifederalists. Federalists were a group of people that advocated for a system of government, while Antifederalists opposed the creation of a stronger America. The Article of Confederation  was designed as a loose confederation of 13 states, and reflected principles of the Declaration of Independence. But, difficulties began to arise with the new Constitution when economic weakness and farmers revolt proved the Article was a poor form of government, along with opposing views from Federalists and Antifederalists, verifying that an inadequate document had been created.

The Articles of Confederation were placed as a form of temporary government. However, the Articles did not address the many problems the United States was having and going to have at the time. Therefore The Articles of Confederation were one of the weakest forms of functioning governments.

The colonies and their mother country were at their brinks with each other. Taxes, rebellion, and unreasonable law pushed these nations into battle which would be known as the American Revolution. The separated colonies would unite and fight together for their well deserved independence. Throughout this the first government was set up by the Continental Congress known as the Articles of Confederation. Some may argue that the Articles were effective in expanding the nation; however, the Articles proved to be ineffective when dealing with the falling economy and taking control of the colonies.

The Articles of Confederation were seen by the Anti-Federalists as a solution to finding a government binding document instead of the Constitution. Although the Articles of Confederation could draw up treaties, borrow money, and produce money they could not enforce treaties, repay the money that was borrowed, and it could not stop certain states from the attempts of issuing their own money. These were just some of the reasons the Federalists believed that the Articles of Confederation could no longer be used to run a country. The Constitution was believed to solve all of these problems with the states as a whole but also give the states the power that they longed for. In order for all of the power to be divided, three branches of government were made; executive, legislative, and judicial.

The Articles of Confederation wasn't necessary the most efficient document for the American people to abide by. The biggest faults of

“The Constitution devotes the national domain to union, to justice, to defense, to welfare and to liberty” (Maier 154). This quote, stated by William Henry Seward, displays the strength and stability that the Constitution had over the nation, and the liberty and justice it supplied for all of its citizens. Although the Constitution and the Articles of Confederation have similarities, they have many differences, which proved that the Articles of Confederation were a weaker document in comparison. It can be said that the Articles were the “rough draft” to the final living document, which significantly influenced and “ruled” our government, as it still does today.

They did not trust strong governments, so the central government very little power (Murphy). There was no court system given to the national government so the states were in charge of it all, which meant complaints could not be filed against them (Brackemyre). One of the only powers the national government had was to declare war but they were not allowed to raise an army to fight it and it lacked a chief executive to conduct foreign affairs. The United States also had an ineffective legislative under the Articles of Confederation. Amendments that they wanted to be passed needed to be vote on unanimously and there had to be a nine out of thirteen vote to pass a law (Kelly). Each state also had only one despite their population. Under the Articles, the government did not have a stable economic system, lacked key central leadership and had an inefficient legislature.
