Test MOD 3 Many ADEA suits arise from workforce reductions. What factors should an employer consider to determine which employees are to be laid off? When employers are considering determining which employees off during workforce reductions, they must consider factors other than age period they have to objectively evaluate entire workforce rather than just laying off a greater number of older workers. Because of the older workers benefit protection act of 1990 which was an amendment of the ADEA this provided provisions when dealing with workforce reductions. If employers, they can offer voluntary early retirement if possible. Explain the term “qualified individual with a disability.” A “qualified individual with a disability,” is an individual who is qualified who has a disability who can perform the work with reasonable accommodations. These individuals can fulfill the requirement of the job despite the disability. Explain the coverage of the Equal Pay Act. The equal pay act as if federal legislation that women and men of forming considerably equal work should be paid an equal salary. This also includes local and state government employees. Substantially equivalent work involves equal effort equal skill equal responsibility and equal working conditions. This does not include pay differentials when it comes to systems such as seniority, merit based pay system, practice productivity based pay system and factors other than sex. List types of discrimination and give an example for each type. Title 7 of the Civil Rights Act of 1964 was a federal legislation that outlawed discrimination when it came to employment, housing, public accommodation, education, and employment, based on race, color, sex, religion, or national origin. They just recently extended discrimination of sex to also mean sexual orientation or sexual identity. This means that you cannot be discriminated against because of your color your sexual orientation what religion you have or your national origin. Discuss the enforcement of Title VII. Title VII is administered by the equal Employment Opportunity Commission. They are a federal agency that enforces the civil rights laws and workplace discrimination. Guideline to regulations require that they post notices summarizing the Civil Rights Act requirements. All employers are to keep records relevant to any possible civil rights violations.
