SLIDE 2 First I will briefly outline the important aspects of the ethical dilemma presented in the case study. Then, I will present the major ethical challenges in this dilemma, following this, I will describe the legal challenges followed by the sociocultural aspects which present a challenge in this dilemma. Then, I will identify the specific ethical guidelines that are applicable to this case as per the 2017 edition of the APA code of ethics. Finally,I will discuss how leaders can use ethical principles to ensure data is equitable and accessible to every individual within the organization. SLIDE3 The case study I will be presenting involves an ethical dilemma which deals with a conflict between the duty to protect confidentiality and making sure the organization is engaging in ethical behavior. The potential violation of ethical standards, misuse of PII – private identifying information, and breach of confidenetiality. Participant data was misused by HR and used to make decisions regarding the hiring and/or promotion of individuals. This data was not validated for this purpose,. SLIDE 5 Ethical challenges of the case study: 1. The breach of participants confidentiality is an ethical violation per the APA, 2017 2. n Korenman 2006 explains bias in an organizations hiring and promotion processs can lead to factors other than job performance influencing the outcomes of promotions and hiring. Leading to a selection process which could be compromised in the fairness and objectivity. 3. As a member of the IRB I have a repsonbility to uphold ethical standards in research and participant protection. Failure to address and resolve this misuse of data and breach in confidentiality violates the mission of the IRB Korenmen 2006 4. as an i-o psych I have a duty to adhere and uphold the ethical principles and .failure to do comprises my own integrity and credibility within the field. 5. It is important to maintain an equilibrium between duty of maintaing confidentiality and upholding ethical standards. SLIDE 6 LEGAL CHALLENGES 1. A breach in confidenality by an organization can lead to various ramifications (BrewerLong, 2021). 2. Using the data for purposes other than what the data was intended for leading to the introduction of bias and potentially discrimination in hiring processes. Marcovitch & Rancourt, 2022 state if a hiring or promotion decision was made as a esult of the bias data this could be a violation of the EEOC, even it it was unintentional. If any person felt adversely about the a decision could lead to violation of these laws.
3. I am legally obligated to protect the participant s rights. If I fail to resolve this there could be legal liabilities. DE 7 SOCIOCULTURAL CHALLENGES korenman 2006 explains a breach of confidenality could result in a lack of trust in the organization. Shook et al. (2019) found that when employees lose trust in their employers, the business becomes more likely to experience a loss of almost ten percent of their earned revenue. Levine & Blit (2023) explains these biases could have a profound impact on diversity and equality within the workplace. It could cause the organization to overlook qualified applicants. Furthermore, hiring biases could lower diversity within the organization’s workforce. SLIDE 8 APPLICABLE ETHICAL GUIDELINES 1. CONFIDENTLAITY LEADERS SHOULD TREAT EMPLOYEE DATA WITH EXTREME CONFIDENITALITY(LEVINE ET AL., 2024). Levine et al., 2024 expalins leaders should establish protocols as well as safeguards in or to protect sensitive information and only allow those with authorization to have access to sensitive data 2. INFORMED CONSENT it is imperative leaders obtain informed consent any time data is collected or if data is to be used for a specific purpose. Informed consent needs to be collected for each specified purpose of data 3. Benefience and nonmaleificance .According to Dash, 2020 it should be a priority of leaders to minimizing harm in the use of employee data , it is important to consider whether there will be an impact on well-being of employees, as well as making sure assessments are valid for the purposes they are being used for. 4. Fairness and equity Levine et al., 2024 states the ethical guidelines explain it is ctucial to always treat every individual with fairness and equity. Integrity and professionalism this principle, principle c expressly states psychologists must always promote the qualities of honesty, being truthful , and being accurate in all they do and never engage in any unethical activites Dash, 2020. The organization misuse of data and confidentiality breaches undermines these principles and creates a distrust in the organization as a whole Korenman, 2006. Principle E of the ethics code respect for individuals autonomy this principle states that psychologists show respect for all people and respect their dignity at all times. the use of participants data inappropriately without informed consent is in violation of this ethical principle and completely disregards the indvidiuals autonomy. principle B fidelity and responsibility this principle states psychologist make sure to avoid misconceptions about their roles and responsibilities as well as accept responsibility for their behavior if it is necessary and always ethically manage any conflicts that may arise which may cause another individual to be at risk of exploitation or harm.
