CPPREP4002 - Access and interpret ethical practice in real estate (Release 1)
Prosecution Report
Part 1 - Description Write a short description of the unethical practice that has occurred.
The unethical practice that occurred was the making of false or misleading representations to vulnerable consumers. Quantum Housing Group, which operated in the disability housing sector, had made false claims about the availability of certain homes, leading vulnerable consumers to believe that they
had secured a home when in fact they had not.
The Federal Court of Australia found that Quantum Housing Group had breached Australian consumer law and engaged in unconscionable conduct by
taking advantage of these vulnerable consumers. As a result, the court ordered
Quantum Housing Group to pay a penalty of AUD 700,000 and to provide compensation to affected consumers. The court also ordered Quantum Housing Group to establish a compliance program to ensure that it complies with Australian consumer law in the future.

John, a recent university graduate has been hired by a Web design consultancy company to interview their staff to ascertain their current knowledge. The aim of the study is to inform the company about the type of training courses they need to implement. The objective is to highlight areas of overall weakness as opposed to individual shortcomings. Despite this, the type of data John collects will be able to identify individual staff weaknesses. Informed consent clearly states that comments made to John by interviewees are to remain private. Following the study, the Vice President of the company approaches John, asking him “who did well in the study?” John, afraid he will lose his job, proceeds to give the vice-president the key findings, including those identifying individual staff weaknesses.

OPM 301 Case 5 (HAND-Written, Individual submission)
CASE 5A: Using Drones as SCM logistic channel
Using drones to drop off packages could be great for buyers who might want to get certain items as fast as
humanly possible. Back in 2013, when Amazon revealed plans to begin delivering packages via flying
drones through Prime Air, some seemed skeptical about the reality of deploying such a system. Recently,
Amazon doubled down on those claims by releasing information on one of its new drones in action, and it is
seriously impressive.
A new video presented by former Top Gear host Jeremy Clarkson (who is working on a show for Amazon)
takes us through the entire process, from ordering, to warehouse launch, to delivery. The new drone looks a
lot different from the one Amazon showed us a couple of years ago. This one has a more commercial and
streamlined look, and instead of showing the package hanging in open air, the new drone hides the item in a
square compartment. Just Google "Amazon…

director wants to determine a reorder point that will meet the demand for pizza. Pizza sales are normally distributed with a mean of 6

Statement: If the manager increased the price and operated at maximum capacity, the cafe would be profitable.Truthfulness: False
If the cafe operates at the break-even price for their maximum capacity, it means that their revenues would be just enough to cover their costs, resulting in a breakeven point. There would be no profit in this scenario. Increasing the price while operating at maximum capacity may generate higher revenues, but it does not guarantee profitability as it depends on the costs involved.
Statement: If the cost of coffee increased during the week, but the price remained the same, the cafe would still break even.Truthfulness: False
If the cost of coffee increased while the price remained the same, it would directly impact the variable costs per cup. This would lead to a decrease in the gross margin per cup, and therefore the cafe would not break even. The increased cost of coffee would reduce the profitability unless the price is adjusted to compensate for the higher…

To the Internal Revenue Service (IRS), the reasonableness of total itemized deductions depends on the taxpayer's adjusted gross income. Large deductions, which include charity and medical deductions, are more reasonable for taxpayers with large adjusted gross incomes.
If a taxpayer claims larger than average itemized deductions for a given level of income, the chances of an IRS audit are increased. Data (in thousands of dollars) on adjusted gross income and the average or reasonable amount of itemized deductions follow.

Currently, you ask the employees to provide the relevant information to initiate the planning phase of the audit. Further, you plan to draw the data from analytical reviews and substantive testing from the operational database. However, the management of your client wants you to draw the data from the data warehouse. The management argues that the data extracted from the operational database will disrupt the operations. Further, the management points out that operational data are copied weekly into the data warehouse, and all data you need are contained there.

Sample Question and Answer:
Question: James was elderly, disabled, and afflicted with very bad arthritis. One day, his 20 year-old neighbor pulled James’s chair out from under James. The girl said she didn’t mean to hurt him. James was not amused and sued the girl for damages. Will James likely be successful? Yes_____ No_____ Reason [Please state the rule(s) of law and your analysis]
Answer: James would likely win for the tort of battery which is the intentional harmful or offensive touching of another (the “rule of law”). Analysis: Jokes and pranks are capable of resulting in battery. The chair was pulled out intentionally, which caused offensive contact between James’s body and the floor, in that, the chair was arguably within James’s zone of personal bodily integrity and, thus, an extension of his body. The fact that James was not physically injured is irrelevant. All that matters is that the girl intended the act or knew with substantial certainty of the consequences…
